Disclaimer of Liability & Participation
Guided river fishing takes place in a natural environment where conditions can change quickly. While every reasonable effort is made to plan and deliver safe, enjoyable guiding and tuition, participation involves inherent risks which cannot be eliminated entirely.
By booking and/or taking part in guiding or tuition with Jon Kenyon (“the Guide”), you acknowledge and accept the information below.
1. Nature of the Activity
Activities may include, depending on river, season and method:
- Walking along riverbanks, tracks and rural paths
- Wading (entering and exiting moving water)
- Fishing from uneven, slippery or steep ground
- Casting and handling hooks, tackle and fish
- Fishing in low light or at night on selected trips
- Travel between locations within Devon, Cornwall, Exmoor and surrounding areas
2. Assumption of Risk
You understand and acknowledge that participation may involve risks including (but not limited to):
- Slips, trips and falls on uneven or wet ground
- Hazards associated with moving water and wading
- Steep banks, gorges and difficult terrain
- Adverse, changeable weather conditions
- Reduced visibility during night fishing
- Physical exertion, fatigue or cold exposure
- Injury related to hooks and fishing equipment
You agree to participate voluntarily and at your own risk, except where liability cannot legally be excluded.
3. Client Responsibilities
To help ensure a safe and enjoyable day, you agree to:
- Follow all reasonable safety instructions and guidance provided by the Guide
- Inform the Guide in advance of any relevant medical conditions, injuries, allergies, or mobility concerns
- Wear suitable clothing and footwear for outdoor conditions (including appropriate wading gear where required)
- Take responsibility for your own personal property and equipment
- Hold any required rod licence and permits (unless explicitly stated otherwise)
If you are unsure about fitness or suitability for a particular river, please discuss this before booking.
4. Fitness, Mobility & Wading
Some rivers require:
- Walking of approximately 1–2 miles
- Moderate stamina and balance on uneven ground
- Getting in and out of the river (wading)
Where wading is required, the Guide will provide guidance on safe entry, exit, and positioning. You may decline to wade at any time, and plans may be adjusted accordingly.
5. Weather, River Levels & Safety Decisions
Fishing plans are always influenced by:
- River height and flow
- Weather and visibility
- Temperature and safety considerations
- Local bylaws and river rules
If conditions are unsafe or unsuitable, the Guide may adjust the venue, method, timing, or recommend postponement/rescheduling. Safety decisions are final and made in the best interests of all participants.
6. Liability
Save for death or personal injury caused by negligence, the Guide does not accept liability for loss, damage, injury, illness, accident, delay, or inconvenience suffered during participation, including loss or damage to personal property or equipment.
Nothing in this disclaimer limits any liability which cannot legally be excluded under applicable law.
7. Medical Assistance
In an emergency, you authorise the Guide to seek medical assistance on your behalf where reasonably necessary. You are responsible for any medical costs incurred.
8. Photography & Video
Photographs or video may be taken during guided days for promotional or educational purposes. If you do not wish to be photographed or filmed, please notify the Guide in writing before the Activity.
